Spearfactor Spear Fishing LLC ("SpearFactor," "we," "us," or "our") operates spearfactor.com and its subdomains — including our dive-conditions and trip-optimizer tools (the "Site"). This Privacy Policy explains what information we collect, how we use it, and the choices you have. By using the Site, you agree to this Policy.

1. Information We Collect

Information you give us directly:

  • Contact form: first name, last name, email address, and the contents of your message.

  • Account / login: if you create a member account, we collect your name, email, and password (stored encrypted by our platform provider, Wix).

  • Course enrollment: if you enroll in a course, we collect the information needed to deliver it, and payment details are collected and processed by our payment processor (not stored by us).

  • Trip Optimizer "share trip" feature: if you email yourself a trip recap, we collect your email address and, if you check the opt-in box, add you to our email list for occasional SpearFactor updates. These emails are delivered through our email provider, Resend.

Information collected automatically:

  • IP address, device type, browser, operating system, referring URL, pages viewed, and time on site.

  • Cookies and similar technologies used by our hosting platform (Wix) and analytics providers (including Google Analytics) to remember you and measure Site usage.

Information from third parties:

  • If you interact with our social profiles (Facebook, Instagram, TikTok, YouTube, LinkedIn) or click embedded content, those platforms may share limited data with us in accordance with their own policies.

2. How We Use Your Information

We use your information to:

  • Respond to your inquiries and provide the content, courses, and services you request.

  • Operate, maintain, and improve the Site.

  • Send transactional emails (e.g., course access, order confirmations) and — only with your consent — marketing emails you can unsubscribe from at any time.

  • Measure and analyze traffic and engagement.

  • Comply with legal obligations and protect our rights.

We do not sell your personal information.

3. Cookies and Tracking

We use cookies to keep you logged in, remember preferences, and analyze traffic. You can control cookies through your browser settings; disabling cookies may affect Site functionality. Where required by law, we display a cookie banner and honor your choices.

4. Sharing Your Information

We share information only with:

  • Service providers who help us operate the Site (Wix for hosting, Google for analytics, Resend for email delivery, and our payment processor) under contracts that require them to protect your data.

  • Legal authorities when required by law or to protect our rights, users, or the public.

We do not share your personal information with advertisers for cross-context behavioral advertising.

5. Your Rights

  • Access, correct, or delete the personal information we hold about you.

California residents (CCPA/CPRA) and EU/UK residents (GDPR) have additional rights, including the right to lodge a complaint with a supervisory authority.

We keep personal information only as long as needed for the purposes described above or as required by law. Contact-form submissions are typically retained for up to 24 months; account data is retained while your account is active.

We use reasonable administrative, technical, and physical safeguards (including those provided by Wix) to protect your information. No system is 100% secure; we cannot guarantee absolute security.

8. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

9. International Users

The Site is operated from the United States. If you access it from outside the US, your information will be transferred to and processed in the US, which may have different data-protection laws than your country.

10. Changes to This Policy

We may update this Policy from time to time. The "Effective date" at the top will reflect the latest version. Material changes will be announced on the Site.
